Terms & Conditions

• Please be advised that by using the Function provided by FlowJob, you agree to and are bound by our Terms and Conditions as set out hereinbelow.
• Should you, in any way, disagree with our Terms and Conditions as set out hereinbelow, or do not wish to be bound by same, then you should desist in utilising the Function offered by FlowJob.

Definitions

• FlowJob (“FlowJob") is the trading name of 3CB Limited (the “Company”, "we", "our" or "us") registered in Northern Ireland Company No. NI602527 at Office 10, Second Floor, 1 Lanyon Quay, Belfast, BT1 3LG. 
• "Customer" means any person or persons who post a job on FlowJob for the purposes of obtaining a quote or quotes from those Service Providers who are registered thereunder.
• "Service Provider" means any person or business who registers with FlowJob for the purposes of providing quotes as and when requested by Customers, and obtaining and accepting offers of work from those Customers.
• "Job" means an assignment or task which the Customer has submitted on FlowJob, and which requires a Service Provider or Service Providers to offer quotes on.
• "Users" or "you", means any person, persons, business or businesses utilising the Function of FlowJob, and which includes both Service Providers and Customers. 
• "Function" means any service or procedure provided by FlowJob to Users, and which includes but is not limited to: information, services and/or products provided via the Website, by telephone, SMS Text Message and/or email.
• "Website" means www.FlowJob.com, www.FlowJob.ie or www.FlowJob.co.uk and includes all the pages, content and sub-domains contained therein.
• “Content” includes all text, files, postings, messages, photos, videos, images and/or sounds etc which have been made available on FlowJob.
• "Expressing interest", "Expressed interest" means contacting, quoting or messaging a customer via our Function.
• “Purchase Date” means the date on which a Service Provider places a Sales Order with FlowJob, verbally or otherwise
• “Sales Order” means an agreement to sign-up as a paying member of FlowJob in return for the provision by us of certain of the Function

• These Terms and Conditions shall be governed by and construed in accordance with the law of Northern Ireland. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Northern Ireland. 
• If any of the provisions contained herein are rendered invalid or unenforceable in law, such provisions shall be amended and any such amendment which will then be enforceable will, to the maximum extent possible, carry out the original intent of the provision. The remainder of the Terms and Conditions will not be affected in any way and will continue in full force and effect.

• FlowJob is an online marketplace which introduces all types of Service Providers to Customers who require their services.

• Although we make every attempt to ensure that the information in FlowJob is correct and accurate, we are unable to guarantee the accuracy of same, and we are therefore not liable for any problems, losses or claims for losses which arise thereunder.
• By using the Function provided by FlowJob, you acknowledge and are in agreement that we are not acting as a contractor and we are not responsible in any way for any work carried out by the Service Provider. It is the Customer’s responsibility to select a suitable Service Provider and to negotiate their terms for any work to be carried out. Furthermore, Users accept that FlowJob will not be involved or held liable for any agreement, contract or arrangement entered into by the Customer and Service Provider.
• We recommend that prior to entering into any agreement, contract or arrangement with any Service Provider, all Customers should request and obtain confirmation of insurance cover (especially), qualifications, accreditations, credentials, trade scheme memberships, guarantees, and any other necessary documentation. If Users suffer any problems or losses as a result of acting on any information provided in good faith by FlowJob or outside of that information provided by FlowJob, FlowJob will not be held liable in any way whatsoever.

• You hereby agree to use the Website for lawful purposes only and in a manner that will not nor does not infringe the rights of nor restricts or inhibits any other person’s or persons’ use and/or enjoyment of the Website. Job descriptions, profiles, messages and all other content submitted on FlowJob must be civil and tasteful, and should not cause offense or injury to feelings in any way.
• You understand and agree that all Content posted on, transmitted through, or linked from FlowJob, is the sole responsibility of the User who posts on, transmits through or links such content from FlowJob. The User is entirely responsible for all Content posted, emailed or otherwise made available by them through the medium of FlowJob.
• You understand and agree that FlowJob does not control, and is therefore not responsible for Content made available via the Website. Furthermore, the Website and Content may contain links to other independent websites. We make no representations or provide warranty as to the accuracy, comprehensiveness or legitimacy of the information contained in any other of those websites.
• You understand and agree that FlowJob does not in any way investigate or approve Service Providers who are listed on the Website. We believe that the best mechanism for deciding who to hire is determinable by reference to comments made by previous Customers of a particular Service Provider.
• If the User decides to link to any other website, it is entirely at the User’s own risk.
• The User agrees to evaluate and bear all risks arising from or associated with the use of any Content, and understands that he/she/they may not rely on said Content, and furthermore that under no circumstances will FlowJob be liable in any way for any Content or for any claim for loss or damage of any kind arising therefrom.
• The User understands and acknowledges that FlowJob does not pre-screen or approve all Content, but that we retain the right to remove or refuse, any Content that is available on the Website should it violate the letter or spirit of FlowJob’s Terms and Conditions, or indeed for any other reason which FlowJob deems appropriate in the circumstances.

• FlowJob owns all intellectual property rights relating to the FlowJob website, including the designs, graphics, layouts, text and database. The User agrees not to use or replicate any part thereof without first of all seeking and obtaining our express written permission.
• The intellectual property rights on Content which are uploaded to the Website by Users are retained by the copyright owner. The User understands and agrees that this Content, if added, is done so at the User’s own risk. In doing so, the User provides express and irrevocable permission for FlowJob to use, store and display the said Content.

• Your interactions with any organisations and/or individuals which includes payment for and delivery of goods/services, which is sourced via FlowJob, are solely between you and said organisations and/or individuals. This includes conditions, warranties, and any and all representations associated with such dealings. 
• You understand and agree that FlowJob shall not be responsible or liable for any claims for loss or damage of any sort incurred as the result of any dealings with any organisations and/or individuals. FlowJob is under no obligation to become involved in any way whatsoever in the event of a dispute between a User of FlowJob and any third party.
• You understand and accept that the Company, its employees, officers, agents and successors in rights shall be released from any claims, demands and damages of every and any kind, known or unknown, suspected and unsuspected which are in any way related to such disputes and/or our Function

Payment Terms & Refunds

• Should a Service Provider wish to cancel a Sales Order, he/she/they must ensure that FlowJob receives any cancellation in writing or by e mail within 7 working days of the Purchase Date
• We will acknowledge and process your cancellation refund within 5 working days of your written request.

Standard FlowJob Directory Listing (“Standard Membership”)

• Standard Membership is, amongst other things, intended to enable Service Providers to express interest in Jobs which are of interest to them, and which are posted by Customers. Standard Membership is paid for in advance on a subscription basis and refunds will not be granted.
• If a Service Provider sets up an agreement to pay us on a regular basis, payment will automatically be taken on the renewal date of the Service Provider’s Standard Membership.
• The Service Provider will be notified 7 working days in advance of the renewal date by email (to the email address provided) that the Service Provider’s Standard Membership is due to be renewed. Should the Service Provider wish to cancel the agreement he/she/they must do so before the renewal date.
• The Service Provider is at liberty to cancel the agreement by contacting FlowJob, however, he/she/they accept that FlowJob is not responsible in any way for claims for any losses or damages that arise as a result of the failure of the Service Provider to update or cancel their agreement in advance of the renewal date as required.
• From time to time, FlowJob may change the pricing and payment terms of Standard Membership should we choose to do so. In the event that we have provided the Service Provider with 14 days notice of said changes, the Service Provider will be deemed to have agreed to the changes if he/she/they have not cancelled their agreement prior to the scheduled renewal date.
• The Service Provider accepts and agrees that FlowJob has a right to limit or terminate the agreement and remove their presence on FlowJob.
• The Service Provider accepts and agrees that FlowJob retain the right to change the features and privileges of Standard Membership at our discretion.

Premium FlowJob Directory Listing (“Premium Membership”)

• Premium Membership is, amongst other things, intended to enable Service Providers to express interest in Jobs which are of interest to them, and which are posted by Customers and to enhance their own internet presence. Premium Membership is paid for in advance on a subscription basis and refunds will not be granted.
• If a Service Provider sets up an agreement to pay us on a regular basis, payment will automatically be taken on the renewal date of the Service Provider’s Premium Membership.
• The Service Provider will be notified 7 working days in advance of the renewal date by email (to the email address provided) that the Service Provider’s Premium Membership is due to be renewed. Should the Service Provider wish to cancel the agreement he/she/they must do so before the renewal date.
• The Service Provider is at liberty to cancel the agreement by contacting FlowJob however, he/she/they accept that FlowJob is not responsible in any way for claims for any, losses or damages that arise as a result of the failure of the Service Provider to update or cancel their agreement in advance of the renewal date as required.

Priority FlowJob Directory Listing (“Priority Membership”)

• Priority Membership is, amongst other things, intended to enable Service Providers to express interest in Jobs which are of interest to them, and which are posted by Customers and to enhance their own internet presence. Priority Membership is paid for in advance on a subscription basis and refunds will not be granted.
• If a Service Provider sets up an agreement to pay us on a regular basis, payment will automatically be taken on the renewal date of the Service Provider’s Priority Membership.
• The Service Provider will be notified 7 working days in advance of the renewal date by email (to the email address provided) that the Service Provider’s Priority Membership is due to be renewed. Should the Service Provider wish to cancel the agreement he/she/they must do so before the renewal date.
• The Service Provider is at liberty to cancel the agreement by contacting FlowJob however, he/she/they accept that FlowJob is not responsible in any way for claims for any losses or damages that arise as a result of the failure of the Service Provider to update or cancel their agreement in advance of the renewal date as required.
• From time to time, FlowJob may change the pricing and payment terms of Priority Membership should we choose to do so. In the event that we have provided the Service Provider with 14 days notice of said changes, the Service Provider will be deemed to have agreed to the changes if he/she/they have not cancelled their agreement prior to the scheduled renewal date.
• The Service Provider accepts and agrees that FlowJob has a right to limit or terminate the agreement and remove their presence on FlowJob.
• The Service Provider accepts and agrees that FlowJob retain the right to change the features and privileges of Priority Membership at our discretion.

Testimonial Service

• Service Providers agree and accept that FlowJob charges a fee for the effort of contacting references which are provided to us by Service Providers. The Testimonial Service is to be paid for in advance and is non-refundable following any attempts at contacting references.
• Service Providers should have obtained their referee’s express permission in order to forward their contact details to FlowJob. FlowJob confirms that any contact details provided, will not be displayed on the site or used for marketing purposes.
• Service Providers should note that their referees should be genuine previous clients, and should be aware that FlowJob will perform a number of checks to ensure this. FlowJob will exercise its sole discretion in determining whether comments from a referee will be posted.

Banner Advertising

• We charge a fee for providing advertising services on the Website to Service Providers. This fee must be paid for in advance.
• Refunds will not be given after we have provided the agreed advertising services.

All Functions provided by us to the Service Provider

• The Service Provider accepts and agrees that he/she/they are obliged to pay any invoices immediately upon receipt of an invoice, and failure to do so shall result in an automatic restriction being placed on their account.
• In certain circumstances, FlowJob may exercise its discretion in offering any refunds.
• We will pass on to the Service Provider any administrative costs incurred as a result of any cheques which do not clear.
• The Service Provider should note that all invoices shall be forwarded to the email address provided. This email address should be up-to-date and in operation and it is the responsibility of the Service Provider to ensure this.

• Service Providers understand and agree that Customers are able to leave Service Providers a FlowJob Star Rating together with any feedback in the event that the Service Provider performed a portion of or all of a job obtained via FlowJob. 
• All Service Providers understand and accept that they will be subject to FlowJob Star Ratings and possible feedback from their Customers. It is further understood that FlowJob will not be responsible for reviewing the content of feedback posted, regardless of whether or not the content is harmful.
• Any Customer who posts feedback is directly responsible for same in terms of accuracy and legality. FlowJob is at liberty to remove feedback and shall do so at our sole discretion.
• Any use of illegal activity, profanity, libellous or inappropriate behaviour including any form of abuse of FlowJob’s feedback function or any other part of the FlowJob Website may result in that User/Users being banned from using FlowJob and possibly being reported to the relevant authorities.
• FlowJob conducts checks on feedback, and if it is determined that feedback is not authentic, FlowJob has discretion to remove same.

• Users acknowledge and accept that FlowJob may limit, for example, the maximum number of days that content is retained by the Website, the maximum number and size of postings, email messages, etc., including other Content that may be transmitted or stored by the Website, and the frequency with which Users may access the FlowJob Website. Users should note that this is not a comprehensive list.
• Users understand and agree that FlowJob is not responsible or liable for the deletion or failure to store any Content maintained or transmitted by the Website. Users should also acknowledge that FlowJob reserves the right at any time to modify or discontinue the Website (or any part thereof) with or without notice. FlowJob is absolved of any liability to Users or any other third party for any modification, suspension or discontinuance of any of FlowJob’s Function.
• Users accept and agree that FlowJob shall not be liable for any claims for loss or damage arising from the provision (or non-provision) of any part of the Function. This shall extend to loss of profit or consequential loss or damage.

• All Users understand and agree that FlowJob in exercising its discretion has the right to delete or deactivate a User’s account and email address, or otherwise remove or restrict access to or use of the Website. This may be done immediately and without notice, and any content within the Website may be deleted or discarded, for any reason, including, without limitation, if FlowJob believes that the User has acted inconsistently with the letter or spirit of the terms and conditions set out herein.
• Users accept and agree that FlowJob is in no way liable to you or any third-party for any termination or restriction of your access to the Website.
• Furthermore, Users agree not to attempt to use the Website after having been removed.

• FlowJob reserves the right to alter, amend, change or update the terms and conditions contained herein, from time to time, as is deemed necessary. As a User of FlowJob, you will be responsible for acknowledging any alterations, amendments, changes or updates to these terms and conditions by visiting this section on a regular basis. Any significant changes in the said terms and conditions will be conveyed to all active Users by email to the email address provided.

• All Customers are aware of and understand that FlowJob operates on an agency basis only and no contractual relationship of any kind whatsoever exists between FlowJob and any of its Customers. 
• FlowJob cannot be held responsible for any default or breach of obligations on behalf of the Service Provider, and is fully absolved and indemnified of all and any liability pertaining thereto. 
• Furthermore, FlowJob will not indemnify nor compensate the Customer for any and all loss damage or injury suffered, caused or sustained by any act or omission on the part of the Service Provider or by reason of his or her negligence or the non-fulfilment or non-observance of any of his or her obligations, nor for all or any costs of any proceedings for the recovery of any loss or sums incurred as a result of the negligence or the non-fulfilment or non-observance by the Service Provider of his or her obligations.
• In addition, FlowJob does not accept any liability whatsoever in the event that the Customer fails to pay or defaults in payment of consideration for services provided by the Service Provider.
